Workshop on the new Public Enterprises Act 2010 for Board Directors and CEOs

8 March 2011. The Ministry of Public Enterprises, in conjunction with the ADB, conducted a half-day workshop today, aimed at familiarizing Directors and Chief Executive Officers of public enterprises with the new Public Enterprise (Amendment) Act and its implications on public enterprise operations.

The hope was that this will ascertain directors to be in a better position in understanding of their respective roles and compliance with the Acts.

A number of directors and chief executive officers of Government Enterprises were in attendance today, where the Minister for Public Enterprises, Hon. Clive Edwards was also present to deliver the keynote address, and formally opens the workshop.

At the onset of the program, ADB Consultant Mr. Christopher Russell, commenced with discussions of comparative performance of SOEs (Public enterprises) in Tonga in comparison to other Pacific Countries, followed by highlighting the imminent key issues with the Public Enterprises Act 2002 and rationale for the 2010 Amendment.

In a joint discussion of the major changes in the Amendment Act and how they affect the Public Enterprise directors, including the impact of Companies Act on director duties, further clarifications were made by Mr. Russell and Mr. ‘Inoke Vala, Director for Public Enterprises.

In the light of such a workshop, this serves to not only discuss implementation challenges on the amended PE Act but also provides an opportunity for an open discussion on the Public Enterprises Act and relevant acts as well as SOE performance.

A similar workshop will take place this Friday, 11 March, at the Dr. Moulton Hall, Free Wesleyan Office in Nuku'alofa, to accommodate other directors and public enterprises CEOs counterparts that did not attend today's workshop.
